The Investigator III position is responsible:
- For investigating both claims and complaints filed by employees against current or former employers.
- Conduct investigations to determine if an employee is due unpaid wages and if so the amount of wages due.
- Investigate employers for compliance issues; if the employer is found to be out of compliance the Investigator will make recommendations to bring the employer into compliance; if found to be out of compliance, will determine if a civil penalty is to be rendered to the employer and establish the dollar amount of the civil penalty.
This position requires the investigator to evaluate each case for compliance with the earned paid sick time, wage and minimum wage claim law on a case by case basis. Often, this position will conduct field visits in order to obtain necessary documentation for complete and consistent evaluation of the facts at hand.
The Investigator will;
- Receive and evaluate completed claim forms; contact the parties involved (employer & employee) to obtain any documentation; weigh evidence received to determine the issues involved;
- Make additional contact, if necessary, to clarify vague, arbitrary or unresolved concerns by both parties.
- Conduct field investigations to obtain information and documentation from uncooperative employers and other involved parties.
- Travel throughout the State of Arizona to make contact with employers and claimants; meet with involved parties and examine evidence;
- Provide employers with education of the minimum wage and earned paid sick time law (EPST) and assist them in becoming compliant with the law;
- Write and keep activity logs of actions taken and information received; and relevancy of facts uncovered.
- Keep written notes of conversations with involved parties.
- Render a written determination with findings of fact, conclusions and a final order based on the investigative evidence obtained and documented.

- AZ Driver’s License Required
In-State travel is required in this position approximately 20 to 30% of the time. Requires possession of and ability to retain a current, valid state-issued driver's license appropriate to the assignment. Employees who drive on state business are subject to driver's license record checks, must maintain acceptable driving records and must complete any required driver training (see Arizona Administrative Code R2-10-207 (12)). Employees may be required to use their own transportation, as well as maintaining valid motor vehicle insurance and current Arizona vehicle registration; however, mileage will be reimbursed.
Knowledge, Skills, & Abilities
- Investigative techniques and practices.
- Statutes, rules and policies, particularly in the area state and federal labor law.
- Arizona Labor Department's statutes and rules relating to wage payment law and the filing of wage claims (A.R.S. 23-350 et seq. and A.C.C. R20-5-1001); statutes and rules specifically relating to the youth employment program (A.R.S. 23-230 et seq.) and statutes and rules relating to minimum wage (A.R.S. 23-363 et seq. and A.C.C. R20-5-1201).
- Federal laws FMLA and FLSA and how they relate to state employment issues.
- Analytical techniques; business practices including accounting procedures and payroll administration; the ability to analyze business policies, employment agreements and wage payment policies that apply to commissions, bonuses, overtime and vacation leave.

Ideal candidates will have:
- Three years’ experience conducting complex regulatory, law enforcement or private investigations.
- Courses or training in investigation techniques and procedures.
- Training in legal procedures pertaining to regulatory, law enforcement or private investigations.
