About Suspension of a Claim
An injured worker's benefits are subject to unilateral suspension by a carrier or self-insured employer if the injured worker does any of the following:
- Leaves the state without the written approval of the Industrial Commission. For more information on this topic, see Filing a Request to Leave the State.
- Fails to file an annual report of income. An injured worker who is receiving monthly loss of earning capacity award payments is required to report annually his/her income to the carrier. Failure to do so could result in suspension of benefits until such time as the report is filed.
- Refuses to submit to an independent medical examination or obstructs one.
- Becomes incarcerated. Compensation benefits are suspended during this time, but medical benefits are continued and any court-ordered child support payments are paid.
