Regulatory Agenda for 2016

Note: The Industrial Commission of Arizona is not engaging in informal or formal rulemaking activities except where approved by the Office of the Arizona Governor, in compliance with Governor Douglas A. Ducey’s Executive Order 2015-01. 

The Industrial Commission of Arizona presents the information below to comply with A.R.S. § 41-1021.02. The Industrial Commission of Arizona may undertake rulemaking even if the rulemaking is not included in the annual regulatory agenda. A.R.S. § 41-1021.02(D).

  1. Rulemakings Expected to be Underway in 2016, Including Notices of Docket Openings, Notices of Proposed Rulemakings, and Notices of Final Rulemaking:

    Industrial Helmets / Head Protection
    Cranes and Derricks
    Crane Operator Certification Extension
    Electric Power Generation, Transmission, and Distribution Safety Standards
    Recordkeeping
    Confined Spaces in Construction
    Evidence Based Medical Treatment Guidelines
    Walking Working Surfaces and Personal Fall Protection Systems 
        (Slips, Trips, and Fall Prevention)
    Improved Tracking of Workplace Injuries and Illnesses
    Updating OSHA Standards Based on National Consensus Standards 
        Eye and Face Protection
    Rules of Agency Practice and Procedure Concerning OSHA Access to
        Employee Medical Records
    Aggregate and Specific Insurance Policies (A.A.C. R20-5-715)

The Industrial Commission of Arizona is required to supply information on potential sources of federal funding for each proposed rulemaking under A.R.S. § 41-1021.02(B)(2). The Arizona state Occupational Safety and Health Program, administered by the Arizona Division of Occupational Safety and Health, part of the Industrial Commission of Arizona, receives federal grant support for operations of the program. Although there is no specific federal funding for individual rules or rulemaking, the Industrial Commission is required, as a term of the federal funding agreement and as part of the state OSHA program, to adopt safety standards that are at least as effective as federal safety standards and to adopt regulations that are substantially identical to federal regulations.
